Challenging Unfair ACRs

The Annual Confidential Report (ACR) or Annual Performance Appraisal Report (APAR) is crucial for promotions. Unfair or inaccurate ACRs can destroy careers.

My ACR was downgraded without any reason. What can I do?

You can challenge the ACR through representation and, if unsuccessful, before AFT. Adverse remarks must be justified and communicated to you. Arbitrary downgrading can be challenged.

I was superseded but my juniors with similar ACRs were promoted. Is this discrimination?

Possibly. If similarly placed officers were treated differently without valid reason, it could be arbitrary discrimination. Each case needs careful analysis of facts.

How important are ACRs for promotion?

Critical. ACRs are the primary document for assessing suitability for promotion. Even a single adverse ACR in the review period can affect promotion prospects.

Can I get actual promotion through court/tribunal?

AFT can direct reconsideration and, in appropriate cases, can direct promotion. However, tribunals generally don’t directly order promotion—they ensure fair consideration.

What is the limitation period for promotion disputes?

Generally one year from the date of supersession or knowledge thereof. However, you should challenge as early as possible.
