I was discharged without any show cause notice. Can I challenge?

Yes. Show cause notice is a fundamental requirement of natural justice. Discharge without it is procedurally illegal and can be challenged.

My services were terminated citing “Services No Longer Required.” Is this valid?

SNLR terminations can be challenged if arbitrary or if proper procedure wasn’t followed. Many SNLR terminations have been successfully challenged.

Can I get my pension if I was discharged before completing pensionable service?

If the discharge itself is challenged and you win, the period of illegal termination counts towards pensionable service. In some cases, compensation may be awarded.

What is the limitation period for challenging termination?

Generally, AFT application should be filed within one year of termination. However, delays can sometimes be condoned. Act quickly.
