Paramilitary Forces Legal Matters

Comprehensive Legal Services for BSF, CRPF, CISF, ITBP, SSB & Other CAPFs

India’s Central Armed Police Forces (CAPFs), commonly known as paramilitary forces, serve in the most challenging conditions—from hostile borders to internal security operations. Yet these brave personnel often face legal challenges similar to regular armed forces but with different forums and procedures.

At Ajit Kakkar and Associates, we extend our military law expertise to all paramilitary forces. While their cases are typically heard before the Central Administrative Tribunal (CAT) rather than the Armed Forces Tribunal, the principles of service law and our advocacy expertise remain equally relevant.

Unique Challenges of Paramilitary Personnel

Hazardous Duty Conditions

Border postings in extreme weather, counter-insurgency operations, anti-terrorist duties, high-altitude deployments.

Disability Recognition Issues

Service-attributable disabilities often disputed. Medical board assessments challenged. Environmental health impacts ignored.

Limited Awareness

Many paramilitary personnel unaware of legal rights. Less organized veteran associations than armed forces.

Similar Sacrifices, Different Treatment

Serve alongside armed forces in operations but often receive different benefits. We fight for equal justice.

FAQs – Paramilitary Legal Matters

Which court handles paramilitary forces cases?

Central Administrative Tribunal (CAT) handles service matters of paramilitary forces, not the Armed Forces Tribunal. Appeals go to High Courts and Supreme Court.

Are paramilitary forces covered under OROP?

Traditional OROP applies to Army, Navy, Air Force. However, paramilitary forces have been granted similar benefits through various government orders. We can help if these benefits are not being correctly applied.

I was injured on duty at the border. Am I entitled to disability pension?

Yes, if the injury is attributable to service. We can help establish this connection and claim your rightful disability pension.

My termination order was issued without proper inquiry. Can I challenge it?

Yes. If procedural requirements were not followed, termination can be challenged before CAT. We have successfully reinstated many paramilitary personnel.
