Q: Can a civilian lawyer represent me in court martial?
Yes. Under Army Act, you have the right to engage a civilian lawyer of your choice in addition to the military defending officer.
Q: My ACR has adverse remarks. What can I do?
You can challenge through representation to superior authority or AFT application. The key is establishing procedural violations or arbitrary remarks.
Q: My disability pension was rejected after medical release. Is this common?
Unfortunately, yes. These can often be challenged successfully by establishing proper attributability to service.
Q: Can I file an AFT case while still serving?
Yes. Serving personnel can file AFT cases for service grievances. However, proper procedure must be followed.
Q: What is the limitation for Army pension cases?
Generally, AFT applications should be filed within one year of the cause of action. Delays can sometimes be condoned if sufficient cause is shown.
Q: Can I claim family pension after my father’s death?
Yes. Eligible family members can claim family pension. Eligibility depends on your relationship and other factors.
